Terms of Service

Overview: By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, and/or customers.

Our store is hosted on WordPress using WooCommerce, and various Print-On-Demand company services.

Products: we have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any color will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

Certain products may be available exclusively online through the website. These products may have limited quantities and are subject to return or exchange only according to our Return Policy.

Pricing:All prices are listed in U.S. Dollars. Sales tax is applied to orders in accordance with current California State law.

Method of Payment: For online sales, we accept payment processed through PayPal and credit card processed through Stripe. Refer to the official PayPal website or Stripe website for terms of use.

Cancellation: Our customers have thirty six (36) hours from placement of an order to cancel.

Delivery; Risk of Loss: Please allow 2-3 weeks for delivery. If delivery delays are projected, we will provide our customers with timely and accurate status for their order. Once the print is received and inspected, immediately contact Donald Towns Art if the print is damaged so that the deficiency can be rectified in a timely manner and a claim can be filed with the carrier.

Any stated delivery dates are approximate. The Seller will not be liable for any losses, damages, penalties, or expenses for failure to meet any delivery date.

Returns: We are confident that our customers will be thrilled with the quality and beauty of the art. However, if you choose not to keep it for whatever reason, the print may be returned within thirty (30) days from the delivery date. Our customers may choose either (1) a full refund of the price paid to Donald Towns Art, less additional shipping costs if applicable, or (2) a credit in the same amount towards purchase of other prints from our catalog. To complete your return, we require a receipt or proof of purchase.

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund. Refunds will be made through PayPal or Stripe.

If you haven’t received a refund yet, first check your bank account again. Then contact your credit card company, it may take some time before your refund is officially posted. Next contact your bank. There is often some processing time before a refund is posted. If you’ve done all of this and you still have not received your refund yet, please contact us at donaldtownsart@gmail.com.

If 30 days have gone by since your purchase, unfortunately we can’t offer you a refund or exchange.

The customer is responsible for packaging, handling, and shipping costs incurred for returned prints. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund. If you are shipping an item over $75, you should consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.

Limitation of Liability: Donald Towns Art will not be liable for any indirect, special, consequential, or punitive damages arising out of or relating to this agreement or the transactions it contemplates (whether for breach of contract, tort, negligence, or other form of action) and irrespective of whether the Seller has been advised of the possibility of any such damage. In no event will the Seller’s liability exceed the price the Buyer paid to the Seller for the specific Goods provided by the Seller giving rise to the claim or cause of action. The Seller will not be liable for delays in performance or for non-performance due to unforeseen circumstances or causes beyond the Seller’s reasonable control.

Limitation of Actions: No action arising out of or relating to this agreement or the transactions it contemplates may be commenced against the Seller more than 12 months after the basis for such claim could reasonably have been discovered.

Protection of Your Personal Information: We respect your privacy; all personal information provided by our clients is strictly confidential. Donald Towns Art will never knowingly share, sell, or otherwise divulge our clients’ personal information to any third party person, organization, or business.

Security: to protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

Changes to this Policy: Donald Towns Art reserves the right to make changes to our website, our policies, and our Terms and Conditions at any time and at our sole discretion. Changes and clarifications will take effect immediately upon their posting on the website. Continued use of our website and a willingness to conduct business transactions after implementation of changes constitutes your binding acceptance of those changes.

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.
